Our Respect for Copyright

Real Estate Professionals of the South, Inc. (“we,” “us,” or “our”) respects the intellectual property rights of others and expects users of findmississippirealestate.net (the “Site”) to do the same. In accordance with the Digital Millennium Copyright Act (“DMCA”), we will respond promptly to valid notices of claimed copyright infringement.

Reporting Claimed Infringement

If you believe that content on the Site infringes a copyright you own or control, please send a written notice to our Designated Agent (below) that includes all of the following, as required by 17 U.S.C. § 512(c)(3):

  1. A physical or electronic signature of the copyright owner or a person authorized to act on their behalf;
  2. Identification of the copyrighted work claimed to have been infringed;
  3. Identification of the material that is claimed to be infringing, with enough detail (such as the URL) for us to locate it;
  4. Your contact information, including your name, mailing address, telephone number, and email address;
  5. A statement that you have a good-faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law;
  6. A statement, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or are authorized to act on the owner’s behalf.

Our Response

Upon receiving a valid notice, we will remove or disable access to the allegedly infringing material and take reasonable steps to notify the user who posted it. Please note that under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material is infringing may be liable for damages.

Counter-Notification

If you believe material you posted was removed by mistake or misidentification, you may send a counter-notification to our Designated Agent that includes:

  1. Your physical or electronic signature;
  2. Identification of the material that was removed and the location where it appeared before removal;
  3. A statement, under penalty of perjury, that you have a good-faith belief the material was removed as a result of mistake or misidentification;
  4. Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the federal district court for the judicial district in which your address is located (or, if outside the U.S., the district in which we are located), and that you will accept service of process from the person who filed the original notice.

Repeat Infringers

We will, in appropriate circumstances, disable or terminate the accounts of users who are determined to be repeat infringers.

Note on MLS Listing Content

Much of the property listing content on the Site is provided through an IDX feed and is owned by the Mississippi Gulf Coast Multiple Listing Service, Inc. and/or MLS United, LLC, or their members. Concerns about specific listing content may also need to be directed to the applicable MLS or listing broker.
